Payment Terms
These Payment Terms ("Terms") govern your purchases of Calisto products and services. Every purchase is paid by a debit from your Calisto Pay balance. Funding and holding your Calisto Pay balance is governed by the Calisto Pay Terms and is not a purchase of products or services. These Terms supplement the Terms of Service, the Calisto Pay Terms, and the Privacy Policy.
1. Our Commitment to Compliance
It is the intention of North Coast Vacations, Inc. to comply with all laws and regulations in all jurisdictions where we operate. Where the law of your country grants you rights that cannot be waived or limited by contract, those rights apply and override any conflicting provision of these Terms.
2. Contracting Entity
All obligations under these Terms are between you and North Coast Vacations, Inc., RNC 132-08055-6, Pedro Clisante 73, Sosúa, Puerto Plata, Dominican Republic ("Calisto").
3. Currency
3.1. At account creation, you select USD or EUR as your billing currency. This selection is permanent and cannot be changed.
3.2. All amounts shown in your account, invoices, and transaction history are denominated in your chosen currency. Calisto does not perform currency conversion between USD and EUR.
4. Subscription Billing
4.1. Calisto Pro subscriptions are billed monthly from your Calisto Pay balance. Your billing cycle begins on the date you activate your first paid subscription and recurs on the same date each month.
4.2. Subscription charges are debited from your Calisto Pay balance automatically on your billing date. You are responsible for maintaining a sufficient balance to cover recurring charges.
4.3. If your Calisto Pay balance is insufficient to cover a subscription charge on your billing date, you have three (3) calendar days to fund your balance. If the balance remains insufficient after three calendar days, Calisto suspends access to all paid features. Access is restored when the outstanding amount is funded in full.
4.4. Subscription pricing is published on the Calisto website and within the platform. Calisto changes subscription pricing upon thirty (30) days' prior notice. Price changes take effect at the start of your next billing cycle following the notice period.
5. Usage-Based and Commission Charges
5.1. Certain Calisto services incur usage-based charges (including telephony minutes, SMS volume, identity verification, messaging, and custom domain hosting). These charges are metered and billed in arrears, debited from your Calisto Pay balance at the end of each billing cycle.
5.2. Commerce services (marketplace transactions, booking commissions, and similar) are charged as a percentage of the transaction value as published in the applicable pricing schedule. Commissions are debited from your Calisto Pay balance at the time of settlement.
5.3. Detailed usage and commission data is available in your billing dashboard at all times.
6. Invoices and Receipts
6.1. Calisto generates a billing statement at the end of each billing cycle summarising all charges debited from your Calisto Pay balance during that period.
6.2. Statements are available in your account and can be downloaded as PDF. Calisto does not send paper invoices unless required by applicable law.
6.3. If you require a VAT or tax invoice with specific details (tax identification number, legal entity name, registered address), you configure these in your billing settings. It is your responsibility to ensure these details are accurate.
7. Refunds
7.1. Calisto does not issue refunds for subscription payments or usage charges, except as provided in Section 12.
7.2. If a charge was applied in error (a system miscalculation, a duplicate charge, or a charge for a service not delivered), Calisto credits the equivalent amount back to your Calisto Pay balance within ten (10) calendar days of being made aware of the error.
7.3. Calisto is not a party to marketplace transactions. Any disputes or refund requests related to marketplace purchases are directed to the contracting party. Calisto facilitates but does not participate in marketplace transactions.
7.4. Disputed charges must be reported within thirty (30) calendar days of the charge date by opening a support ticket at https://pro.calistoco.com/support/tickets. After thirty days, the charge is final.
8. Taxes
8.1. All prices published by Calisto are exclusive of applicable taxes unless expressly stated otherwise.
8.2. You are responsible for all taxes, duties, and levies imposed by any taxing authority in connection with your use of Calisto services.
8.3. Where Calisto is required by law to collect and remit taxes (including VAT, GST, sales tax, or withholding tax), such taxes are added to the relevant charge and shown separately on your billing statement.
9. Billing Disputes
All billing disputes must first be submitted to Calisto via support ticket at https://pro.calistoco.com/support/tickets. Calisto responds within seven (7) business days, or sooner if required by applicable law.
10. Changes to These Terms
10.1. Calisto amends these Terms by publishing the change on the platform with an updated "Last Updated" date. For material changes, Calisto notifies you by email or in-app notification at least thirty (30) days before they take effect.
10.2. Your continued use of any paid Calisto service after the effective date of a change constitutes acceptance. If you do not agree with a change, you cancel your paid subscriptions before the change takes effect.
11. Governing Law and Jurisdiction
11.1. These Terms are concluded in the Dominican Republic and are governed by the laws of the Dominican Republic.
11.2. Any dispute arising under these Terms, after Calisto's dispute process in §9, is resolved in the courts of Santo Domingo, Dominican Republic, except as provided in Section 12.
12. Jurisdiction-Specific Terms
12.1. Consumers in the Dominican Republic
If you are a consumer under Dominican law:
- If you are not satisfied with Calisto's resolution under §9, you file a complaint with Pro Consumidor (Instituto Nacional de Protección de los Derechos del Consumidor) and obtain a final resolution before initiating any court proceeding.
- No court action can be filed under these Terms until Pro Consumidor has issued a final resolution on the dispute.
12.2. Consumers in the European Union, the European Economic Area, and the United Kingdom
If you are a consumer resident in the EU, the EEA, or the United Kingdom:
- Right of withdrawal. You can withdraw from a paid subscription within fourteen (14) days of activating it, without giving a reason, by opening a support ticket at https://pro.calistoco.com/support/tickets. If you asked for the service to begin during the withdrawal period, Calisto deducts an amount proportionate to the service provided before you withdrew.
- Your courts. You can bring proceedings in the courts of your country of residence.
12.3. Consumers in the United States
If you are a consumer resident in the United States:
- Renewal. Your subscription renews each month and is debited from your Calisto Pay balance on your billing date until you cancel.
- Cancellation. You can cancel your subscription at any time through your account.
