Calisto Pay Terms

These Calisto Pay Terms ("Terms") govern Calisto Pay, a closed-loop prepaid balance available to verified Calisto subscribers. By activating, funding, or using Calisto Pay, you agree to these Terms. These Terms supplement the Terms of Service, the Payment Terms, and the Privacy Policy.

1. Our Commitment to Compliance

It is the intention of North Coast Vacations, Inc. to comply with all laws and regulations in all jurisdictions where we operate. Where the law of your country grants you rights that cannot be waived or limited by contract, those rights apply and override any conflicting provision of these Terms.

2. What Calisto Pay Is

2.1. Calisto Pay is a prepaid balance. When you fund it, you agree to hold a prepaid balance with Calisto. Funding is not a purchase of products or services. A purchase occurs only when a charge is debited from your balance under the Payment Terms.

2.2. Calisto Pay is not a bank account, payment account, deposit account, electronic money account, or any form of regulated financial product. It does not earn interest, offer lending, provide an IBAN or account number, issue a debit card, or facilitate transfers to external bank accounts. Calisto Pay balances are not insured by any government deposit-insurance scheme.

2.3. You can use your Calisto Pay balance to pay for any current or future product or service offered by Calisto, and for nothing else.

3. Contracting Entity

All obligations under these Terms are between you and North Coast Vacations, Inc., RNC 132-08055-6, Pedro Clisante 73, Sosúa, Puerto Plata, Dominican Republic ("Calisto").

4. Eligibility and Activation

4.1. To activate Calisto Pay, you must hold a Calisto account and have completed identity verification to at least Tier 1 (government-issued identity document plus liveness check) through Calisto's identity verification process.

4.2. Calisto declines activation or restricts Calisto Pay functionality if identity verification, sanctions screening, or regulatory requirements applicable to your jurisdiction require it.

4.3. Each Calisto account holds one Calisto Pay balance. The balance is denominated in the currency you selected at account creation (USD or EUR). This cannot be changed.

5. Funding Your Balance

5.1. You fund your balance using the payment methods shown in your account at the time of funding.

5.2. Funds are received by Calisto and credited to your balance in your chosen currency. The credited amount reflects the net amount received by Calisto after any fees or costs charged by the payment provider.

5.3. When you fund your balance through a payment method denominated in a different currency, any conversion is performed by your financial institution or payment provider at their prevailing rate. Calisto has no control over and accepts no liability for third-party conversion rates or fees.

5.4. You are responsible for any fees charged by your bank, card issuer, or payment provider in connection with funding your balance. Calisto does not add a markup to the funding cost charged by its payment partners.

5.5. Calisto imposes minimum and maximum funding limits per transaction or per period. These limits are displayed in your account at the time of funding.

6. How Your Balance Is Held

6.1. Your balance represents a prepaid credit obligation from Calisto to you, redeemable only for products and services offered by Calisto. It is not held in a segregated account on your behalf.

6.2. You do not have any ownership interest in, claim against, or security interest in any specific asset, fund, account, or pool maintained by Calisto. Your right is a contractual claim against Calisto for the delivery of products and services up to the value of your balance.

7. Spending Your Balance

7.1. Your balance is debited for the charges set out in the Payment Terms.

7.2. All debits are recorded in your transaction history with a description, amount, and timestamp. Your full transaction history is available at all times in your billing dashboard.

7.3. Calisto does not process a transaction that would cause your available balance to fall below zero. If your balance is insufficient, the transaction does not complete. It is your responsibility to maintain a sufficient balance.

8. Holds

8.1. Calisto places a temporary hold on a portion of your balance when a charge is initiated but not yet finalised (for example, a usage-metered charge awaiting final calculation).

8.2. Held amounts are deducted from your available balance but are not yet charged. If the underlying charge completes, the hold converts to a charge. If it is cancelled, the hold is released and the amount returns to your available balance.

8.3. Holds that are not resolved within thirty (30) calendar days are automatically released unless a dispute or investigation is in progress.

9. Refunds and Credits

9.1. When a refund is issued for a Calisto product or service, the refunded amount is credited back to your balance. Calisto does not refund to external payment methods.

9.2. Promotional credits, switch credits, or other non-cash credits applied to your balance are subject to the terms under which they were granted and can have an expiry date or usage restrictions. Non-cash credits cannot be withdrawn or exchanged for cash.

10. Chargebacks

10.1. If you believe a funding charge is incorrect, you must contact Calisto first by opening a support ticket at https://pro.calistoco.com/support/tickets. Calisto responds within seven (7) business days, or sooner if required by applicable law.

10.2. Filing a chargeback or payment reversal with your bank or card issuer without first exhausting Calisto's dispute process constitutes a material breach of these Terms. Upon notification of a chargeback, the following occurs:

  • Immediate suspension. Your account is suspended and all access to paid features is revoked.
  • Full reimbursement obligation. You are obligated to reimburse Calisto for the chargeback amount plus all fees, penalties, and administrative costs Calisto incurred as a result of the chargeback, including payment processor penalties, bank fees, and internal investigation costs.
  • Data hold. Your account data, platform content, configuration, and files are held by Calisto and are not available for export until all chargeback-related costs are reimbursed in full. Subscriber Data covered by the Data Processing Agreement is handled per that agreement's return and deletion provisions.

11. Third-Party Payment Providers

11.1. Calisto uses licensed third-party payment providers to process the payments you make to fund your balance. Your use of these payment methods is subject to the terms and conditions of the applicable provider in addition to these Terms.

11.2. Calisto is not liable for the acts or omissions of third-party payment providers, including processing delays, declined transactions, or data breaches originating at the provider.

12. Balance on Account Closure

12.1. Calisto does not return balances to external payment methods upon account closure, unless required by applicable law.

12.2. Upon account closure, any remaining balance (excluding promotional or non-cash credits) can be redeemed for Calisto products and services by activating a new account under the same verified email address within twelve (12) months of the closure date. The balance is transferred to the new account upon successful identity verification.

12.3. Outstanding obligations must be settled before any balance is available for redemption. This includes all unpaid charges, fees, and any chargeback reimbursement obligations under §10.

12.4. Balances that remain unredeemed for twelve (12) months after account closure are treated as abandoned property and handled in accordance with applicable unclaimed-property laws.

12.5. Where mandatory law in your jurisdiction requires the return of funds upon account closure, Calisto complies with that requirement. To make such a claim, submit a request at https://pro.calistoco.com/support/tickets citing the applicable law. Calisto responds within seven (7) business days.

13. Restrictions and Compliance

13.1. You must not use Calisto Pay for money transmission, money laundering, terrorist financing, sanctions evasion, fraud, or any other unlawful purpose.

13.2. Calisto freezes your balance when any of the following occurs:

  • You file a chargeback as described in §10.
  • A payment provider or compliance partner flags your account for potential sanctions, AML, or fraud concerns.
  • Your identity verification expires or is revoked.
  • Calisto detects transactions inconsistent with your stated account purpose or verification tier.
  • A court order, regulatory directive, or law enforcement request requires it.

Calisto notifies you of the freeze and the reason for it within two (2) business days of the freeze taking effect, unless prohibited by law or a regulatory directive.

To unfreeze your balance, complete the following steps in order:

  1. Resolve the triggering event. For chargebacks: reimburse all costs per §10. For expired verification: complete a new identity verification cycle. For compliance flags: provide the documentation Calisto requests.
  2. Submit an unfreeze request at https://pro.calistoco.com/support/tickets with evidence that the triggering event is resolved.
  3. Calisto reviews and responds within seven (7) business days of receiving a complete request. If approved, the balance is unfrozen immediately. If additional documentation is required, Calisto specifies exactly what is needed.

If the triggering event cannot be resolved (for example, a confirmed sanctions match), the balance remains frozen and is closed in accordance with applicable law.

13.3. Calisto complies with all applicable anti-money laundering (AML), counter-terrorism financing (CTF), and sanctions laws. Your identity data is screened against sanctions lists, politically exposed persons (PEP) databases, and adverse media as part of ongoing monitoring.

13.4. If Calisto's compliance partners flag your account as a potential false positive in anti-money laundering or sanctions screening, Calisto requires you to complete additional identity verification before your balance can be reactivated. Calisto notifies you of the specific documentation required and provides a deadline of no fewer than fourteen (14) calendar days to respond. If you do not provide the requested documentation within the deadline, your balance remains frozen until the documentation is received.

14. Data and Account Holds

14.1. If your account is suspended or terminated due to a chargeback, unpaid obligations, or a compliance investigation, your account data, platform content, configuration, and files are held by Calisto and are not available for export until all outstanding obligations are resolved in full.

14.2. Subscriber Data covered by the Data Processing Agreement is handled per that agreement's return and deletion provisions.

15. Liability

15.1. Calisto is liable for accurately maintaining your balance as reflected in the platform ledger. If a system error causes your balance to be incorrectly stated, Calisto corrects the error promptly and, where necessary, reverses or re-applies transactions.

15.2. Calisto is not liable for losses arising from your failure to safeguard your account credentials, unauthorized access to your account caused by your negligence, the insolvency or failure of a third-party payment provider used to fund your balance, or currency fluctuations between the time you fund your balance and the time charges are applied.

15.3. Calisto's total liability under these Terms does not exceed the value of your balance at the time the claim arose.

16. Changes to These Terms

16.1. Calisto amends these Terms by publishing the change on the platform with an updated "Last Updated" date. For material changes, Calisto notifies you by email or in-app notification at least thirty (30) days before they take effect.

16.2. Your continued use of Calisto Pay after the effective date of a change constitutes acceptance. If you do not agree with a change, you close Calisto Pay before the change takes effect, and your balance is handled in accordance with §12.

17. Governing Law and Jurisdiction

17.1. These Terms are concluded in the Dominican Republic and are governed by the laws of the Dominican Republic.

17.2. Any dispute arising under these Terms is resolved in the courts of Santo Domingo, Dominican Republic. If you are a consumer resident in the EU, the EEA, or the United Kingdom, you can bring proceedings in the courts of your country of residence.
